Letter signed B.F. Butler [Attorney General], Washington, to H.R. Gamble, St. Louis. I will undertake the care of the cases mentioned in your letters on the terms stated by you, except that if the cases should be dismissed for want of jurisdiction, as I think will be the fact, my charge will be only $250. It appears to me most judicious, to raise the question of jurisdiction, in limine, and to argue it by itself. I think the Court will be glad to avoid the main argument, if there is any serious doubt as to their power to entertain the case. There are other reasons too, of a public and general nature, which should make every friend to the Union of the States desirous to keep discussions of this nature out of the Federal Courts, except when rendered unavoidable. Colonel Benton thinks he will be prepared on Saturday next to argue the question of jurisdiction, and I then propose to bring it on. Individuals mentioned include Thomas Hart Benton.
